Proposal to declare a public highway in Carnegie

Council gives notice under section 204(1) of the Local Government Act 1989 (Act), that it proposes to declare that part of the land contained within Plan CP173107R on Certificate of Title Volume 09957 Folio 705, shown as hatched on the plan below, as a public highway.

Under section 223 of the Act, Council is required to notify impacted or interested parties of Council’s intention and to offer a formal opportunity to comment on the proposal.

Why are we proposing to declare a public highway?

This proposal is for Leaf Lane — a pedestrian laneway at 85–87 Koornang Road, Carnegie located between Koornang Road and the Woolworths carpark. This laneway has been a key pedestrian route since before 1931, connecting Koornang Road shops with nearby commercial and residential areas.

Declaring a public highway under Section 204 (1) of the Local Government Act 1989 allows continued public access for pedestrians and/or vehicles.

Leaf Lane’s status would be formalised and pedestrians could continue to use it into the future. We could also then secure ongoing access and maintenance.
