Council order under section 26 of the Domestic Animals Act 1994

At its meeting on 23 July 2024 Glen Eira City Council resolved to make the following Order under section 26 of the Domestic Animals Act 1994.

1. Revocation

All previous Orders made by Council under section 26 of the Domestic Animals Act 1994 are revoked.

2. Commencement

This Order commences on 1 September 2024.

3. Dogs must be under effective control

The Owner of any dog must keep the dog under effective control by means of a chain, cord or leash (not exceeding 1.5 metres in length) held by the Owner and attached to the dog while the dog is in a Public Place except where that Public Place is a Dog Off Leash Area.

4. Owner’s obligations in a Dog Off Leash Area

(1) A dog may be exercised off a chain, cord or leash in a Dog Off Leash Area if the Owner:


(a) carries a chain, cord or leash not exceeding 1.5 metres in length sufficient to bring the dog under effective control;
(b) remains close enough to the dog so as to be able to immediately bring the dog under effective control by placing the dog on a chain, cord or leash;
(c) does not allow the dog to worry, threaten or attack any person or animal;
(d) keeps the dog under effective control when in a dog off-leash area by means of effective voice or hand control of the dog so as to
be able to promptly place the dog on a chain, cord or leash if that becomes necessary whether to comply with the provisions of clause 3(1) of this Order or for any other reason;
(e) brings the dog under effective control by placing the dog on a chain, cord or leash immediately upon the dog commencing to worry, threaten or attack any person or animal;
(f) keeps the dog under effective control by placing the dog on a chain, cord or leash (not exceeding 1.5 metres in length) held by the Owner and attached to the dog whenever the dog is within 20 metres of:

(i) Play or Exercise Equipment (unless the Play or Exercise Equipment is fenced off such that access to that area by the dog is prevented);
(ii) a permanent barbecue or picnic area (unless the permanent barbecue or picnic area is fenced off such that access to that area by the dog is prevented);
(iii) a sporting oval that is being used for an organised sporting event (including training or competition);
(iv) the principal location of an authorised school event; or
(v) the principal location of an organised public event.

5. Meaning of words

In this Order:

Dog Off-Leash Area means:

1. the whole of any Reserve during the period specified in the column headed ‘Time’ in Schedule 1 of this Order; or
2. such part of any Reserve that is designated as a Dog Off-Leash Area by signage at the Reserve during the period specified in the column headed ‘Time’ in Schedule 1 of this Order.

Council means Glen Eira City Council.

Owner has the same meaning as in the Domestic Animals Act 1994.

Play or Exercise Equipment means any item or facility of play or exercise equipment installed in a Reserve by Council and designed to be used by children or adults.

Public Place has the meaning given to it in the Summary Offences Act 1966.

Reserve means the area specified in the column headed ‘Reserve’ in Schedule 1 of this Order.
